1. Purpose

These terms govern the purchase and sale of precious metals (gold, silver, and other related products) through the Fortuna Bullion platform. By placing an order, the customer declares that they have read, understood, and accepted these terms without reservation.

2. Purchase Process

The customer may browse the website freely and select the products they wish to purchase. Once added to the cart and the checkout process is completed, the order will be confirmed by email. The purchase and sale contract shall be deemed concluded upon receipt of full payment for the order.

3. Prices and Availability

Product prices are shown in euros (€) and include applicable taxes in accordance with Portuguese law. As precious metals are traded on international markets, prices may change without prior notice up to the time of payment. In the event of an obvious pricing error, Fortuna Bullion reserves the right to cancel the order and notify the customer.

4. Payment Methods

Fortuna Bullion accepts the following payment methods:

WooCommerce payment platform (credit/debit card or other available methods).
Direct bank transfer to the account indicated during the purchase process.

The order will be processed as soon as full payment is received and confirmed. The customer must make payment within a maximum of 2 hours after placing the order. If payment is not received within this period, Fortuna Bullion reserves the right to cancel the order without prior notice, as precious metals prices are subject to daily quotation fluctuations in international markets.

5. Shipping and Delivery

All shipments made by Fortuna Bullion are insured until delivery. Estimated delivery times are indicated during the purchase process and may vary depending on the destination and product availability.

If the package arrives damaged or tampered with, the customer must refuse delivery and inform info@fortunabullion.com immediately.
If the damage or incident is detected after delivery, the customer must report it in writing to info@fortunabullion.com within a maximum of 24 hours after receipt. After this period, no claims will be accepted for transport damage or missing contents.

6. Right of Withdrawal and Returns

In accordance with Directive 2011/83/EU and Decree-Law No. 24/2014 (Portugal), the right of withdrawal (right to cancel) does not apply to purchase and sale contracts for goods whose price depends on fluctuations in the financial market beyond the seller’s control, as is the case with investment precious metals.

Therefore, once the order is confirmed and payment is made, it will be binding and cannot be cancelled, except in the event of a justified error or a cause attributable to Fortuna Bullion. Any other exceptional case must be submitted in writing to info@fortunabullion.com, where it will be reviewed on an individual basis.

7. Warranties and Authenticity

All products sold by Fortuna Bullion are genuine and sourced from internationally recognised refineries or mints. Each item meets the purity and weight standards specified in its description. If an incorrect or defective product is received, the customer must report it in writing within a maximum of 24 hours after receipt for review and possible replacement.

8. Right to Suspend and Unilaterally Cancel Accounts

Fortuna Bullion reserves the right to suspend, restrict, or permanently cancel access to any user’s account, unilaterally and without prior notice, in the following cases:
- Failure to comply with the obligations set out in these Terms and Conditions.
- Use of the platform for fraudulent, unlawful, or bad-faith purposes.
- Disrespect for, or repeated failure to respond to, official communications: This shall be understood as a failure to respond to requests for information, security notifications, or operational messages sent by the platform, where such lack of interaction prevents the proper provision of the service or the administrative management of the account.
- Operational inactivity: At the sole discretion of management, when the account shows no activity or when the continuation of the profile does not align with Fortuna Bullion’s commercial interests or operational standards.
Effects of Cancellation: Closing the account entails the immediate revocation of access to the user dashboard and the deletion of associated data, except for records that the entity is legally required to retain for the applicable technical or legal limitation periods.
No Compensation: As access to and maintenance of the account do not involve any mandatory financial consideration for ongoing subscription services, the user accepts and acknowledges that its termination will not give rise to any right to compensation, damages, or indemnity of any kind.
Notification: Fortuna Bullion may, at its discretion and whenever circumstances allow, send a closure notice. However, there shall be no obligation of prior notice in cases of breach of the terms or where there has been a prior and prolonged disregard of the user’s contact channels.

9. Limitation of Liability

Fortuna Bullion shall not be liable for delays or non-performance arising from force majeure, market fluctuations, or customer errors when entering data. Use of the website is at the user’s sole responsibility.

10. Applicable Law and Jurisdiction

These terms are governed by Portuguese law. Any dispute shall be submitted to the competent courts of Lisbon, without prejudice to the rights afforded to the consumer in their country of residence under Regulation (EU) No. 1215/2012.
